Lilly ICOS Corp. (“Lilly”) develops and markets certain generic medicines in the United States. The United States patent on its generic version of Viagra (sildenafil), issued in November 2003, allows Lilly to produce the generic version of the drug and to market it as a non-branded generic, in the United States. The United States patent on Lilly’s generic version of Cialis (tadalafil), issued in July 2003, allows Lilly to produce the generic version of the drug and to market it as a non-branded generic. Lilly has no rights to the generic version of Cialis. Consequently, the United States patent on Lilly’s generic version of Viagra expires in November 2003.
Lilly and the other defendants, in their respective representative agencies, have no rights to the generic version of Cialis. The generic version of Cialis is indicated for the treatment of erectile dysfunction (ED) in men. ED is a condition that affects many men worldwide and is characterized by the inability to achieve or maintain an erection sufficient to have sexual intercourse.
